1) About these Terms

These Website Terms of Use & Disclaimer (“Terms”) govern your access to and use of the MarryMark website, including any pages, forms, directories, listings, resources, downloads, and related online services we provide through the website (“Website”).

By accessing or using the Website, you agree to these Terms.

If you do not agree, do not use the Website.

2) Definitions

  • Accredited Business means a business that holds a current MarryMark business accreditation (5/6/7 Star Silver or Gold), as recorded by MarryMark.
  • CWP means MarryMark Certified Wedding Professional (an individual credential).
  • Listing means any profile, directory entry, badge display, description, or related information shown on the Website about a business or individual.
  • Scheme Documents means documents that govern MarryMark’s accreditation and credential schemes, including (where applicable):
    • Business Accreditation Terms
    • CWP Credential Terms
    • Business Code of Conduct
    • CWP Code of Conduct
    • Badge & Claims Usage Rules
    • Professional Standards & Complaints Policy
    • Privacy Policy
  • Content means all text, graphics, badges, marks, logos, designs, videos, downloads, and information on the Website.

3) Relationship to Scheme Documents

If you are applying for or holding business accreditation or CWP, your use of MarryMark badges, claims, applications, portals, education access, and scheme participation is governed by the relevant Scheme Documents.

These Website Terms govern general Website use and do not replace the Scheme Documents. If there is any inconsistency, the relevant Scheme Documents prevail for accreditation/credential matters.

4) Permitted use of the Website

You may use the Website for lawful purposes only, including to:

  • learn about MarryMark
  • view listings and information
  • submit enquiries or applications
  • access resources we make available.

You must not:

  • copy, scrape, harvest, or systematically extract data from the Website (including Listings) for commercial use without our written permission
  • interfere with the Website’s operation (including introducing malware, attempting unauthorised access, or bypassing security)
  • use the Website to defame, harass, intimidate, discriminate, or unlawfully target any person or business
  • misrepresent your identity, accreditation status, or authority to act for someone else
  • use MarryMark’s badges/marks except as permitted under the Badge & Claims Usage Rules.

We may suspend or block access if we reasonably believe your use breaches these Terms or creates risk to the Website, users, or scheme integrity.

5) Accuracy, availability, and changes

We aim to keep the Website up to date, but:

  • Content may change without notice
  • the Website may be unavailable at times (maintenance, upgrades, outages)
  • information in Listings may become outdated between verification points.

We do not guarantee that the Website will be uninterrupted, error-free, or free of viruses (although we take reasonable steps to operate responsibly).

6) Directory listings and scheme information (important)

6.1 What accreditation and CWP mean

MarryMark is an independent accreditation and education body for the wedding industry. Our assessments are based on information supplied by the business or individual at the time of application and renewal, including documentation, audits, and training participation (where applicable).

Accreditation indicates that a business or CWP holder has met MarryMark’s standards at the time of assessment and (where relevant) has remained subject to good-standing requirements. It is not a guarantee of future performance, business viability, financial stability, or service outcomes.

6.2 Couples and consumers must conduct their own checks

Couples and consumers should conduct their own checks, make independent enquiries, and enter into contracts directly with the vendor.

MarryMark is not a party to any agreement between couples/consumers and vendors and does not determine contractual liability.

6.3 Listings are not real-time guarantees

While every effort is made to ensure accuracy in Listings and verification tools, we cannot guarantee completeness or real-time accuracy of information and accept no liability for errors, omissions, or changes made by businesses after accreditation.

6.4 Accredited businesses remain responsible

Accredited Businesses remain solely responsible for their ongoing compliance with legal, regulatory, insurance, and professional obligations. MarryMark reserves the right to amend, suspend, downgrade, revoke, or decline renewal of accreditation/credentials in accordance with the relevant Scheme Documents.

7) Third-party websites, links and services

The Website may contain links to third-party websites or platforms (including accredited business websites, social pages, booking tools, or payment/learning platforms). These are provided for convenience only.

We do not control third-party websites and are not responsible for their content, availability, privacy practices, or the services they provide. Your use of third-party sites is at your own risk and subject to their terms.

8) Submissions through the Website

If you submit information through the Website (including enquiries, applications, documents, evidence, complaints, or feedback), you agree that:

  • the information you provide is accurate and not misleading
  • you have authority to provide it (including where it contains personal information of others or client materials)
  • you will not submit unlawful, defamatory, or privacy-breaching content.

We may use submissions for scheme administration purposes in accordance with our Privacy Policy and Scheme Documents.

9) Intellectual property and permitted sharing

All Content on the Website (including MarryMark badges, marks, standards language, and designs) is owned by or licensed to MarryMark and protected by intellectual property laws.

You may view and print Content for personal, non-commercial use. You must not reproduce, distribute, modify, or commercially exploit any Content without our written permission, except where allowed by law.

Badge use is strictly controlled: even if a badge appears on the Website, it may only be used by the accredited party under the Badge & Claims Usage Rules.

10) Disclaimer (general information)

The Website provides general information about MarryMark, accreditation, education, and industry standards. It is not legal, financial, accounting, or professional advice.

You should obtain your own independent advice before making decisions based on information from the Website.

11) Limitation of liability

To the maximum extent permitted by law:

  • we exclude all liability for any loss or damage arising from your use of (or inability to use) the Website, including reliance on Content or Listings, website outages, third-party links, or errors/omissions; and
  • we are not liable for any dispute, cancellation, negligence, service failure, or loss arising from engagements between couples/consumers and vendors. 

Non-excludable rights: Nothing in these Terms excludes, restricts, or modifies rights or remedies that cannot be excluded under applicable law (including the Australian Consumer Law).

12) Indemnity (misuse of the Website)

To the extent permitted by law, you agree to indemnify MarryMark against losses or claims arising from your unlawful use of the Website, your breach of these Terms, or content you submit that infringes third-party rights or violates privacy/confidentiality obligations.

13) Privacy

Our collection and handling of personal information is governed by our Privacy Policy, including how we manage forms, enquiries, applications, and complaints.

14) Changes to these Terms

We may update these Terms from time to time. The current version will be published on the Website with the effective date. Your continued use of the Website after updates means you accept the updated Terms.

15) Governing law

These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of NSW.
